Obtaining Modifications and Enforcement

After the court establishes custody orders, circumstances, if significant, can warrant a modification of orders.

Child support and custody agreements can always be modified if significant changes occur in the lives of the parents or children. The changes may include:

  • Changes in income or financial circumstances such as job loss
  • Relocation due to a new job
  • Change in child's or parent's health
  • Change in parental ability to care for the child
  • Accusations of being an unfit parent

Conflicts may occur if orders custody orders are not being followed. In situations where child support payments may be in arrears you should contact the domestic relations section who is managing your support order. If a parent is acting in contempt of court, the best course of action is to bring your complaints to me. As your lawyer, I can discuss your enforcement and modifications options and guide you through the legal process for your county:

  • Filing a petition for modification or for contempt/enforcement of original court orders will frequently go to a conciliation conference, then to mediation and counseling prior to a court hearing.
